PRICES AND PAYMENT

Prices are displayed in U.S. dollars and may change without notice. Applicable taxes, service charges, delivery fees, tips, and other charges will be shown before checkout when possible.

Although we make reasonable efforts to keep information accurate, typographical errors, incorrect prices, and technical errors may occur. If an item is listed at an incorrect price, we may contact you for approval of the corrected price or cancel and refund the affected item.

Payment must be made using an accepted payment method. Payment information is processed by authorized third-party payment providers.

PRODUCT AVAILABILITY AND SUBSTITUTIONS

Our products are prepared or stocked in limited quantities and may become unavailable without notice.

Product availability may vary by day, season, supplier, and location. If an ordered item is unavailable, we may:

• Contact you to approve a comparable substitution
• Remove and refund the unavailable item
• Cancel the affected portion of the order

We will not knowingly charge you for an unapproved higher-priced substitution.

MENU DESCRIPTIONS AND IMAGES

We make reasonable efforts to present accurate menu descriptions, ingredients, portions, prices, and photographs. However, handmade and freshly prepared foods may vary in appearance, size, garnish, presentation, or packaging.

Product images are provided for general illustration and may not depict the exact item received. Manufacturers may also change grocery-product packaging or labeling without notice.

FOOD ALLERGIES AND DIETARY CONCERNS

Mulberry Street handles common food allergens, including milk, eggs, wheat, soy, peanuts, tree nuts, fish, shellfish, and sesame.

Our products may be prepared, sliced, stored, or packaged in shared areas or on shared equipment. We cannot guarantee that any item is completely free from allergens or cross-contact.

Menu descriptions may not identify every ingredient. If you or someone consuming the order has a food allergy, intolerance, or dietary restriction, call us at (732) 477-4520 before placing the order.

Online notes alone are not sufficient notice of a serious food allergy. Customers are responsible for determining whether a product is appropriate for their individual dietary needs.

PICKUP AND DELIVERY

Pickup and delivery orders are governed by our Pickup and Delivery Policy.

Customers must select the correct date, time, address, and fulfillment method. Pickup times and delivery estimates are not guaranteed and may be affected by order volume, traffic, weather, product availability, or circumstances outside our reasonable control.

Customers are responsible for promptly collecting, receiving, refrigerating, storing, and serving perishable products safely.

CATERING ORDERS

Catering orders are also governed by our Catering Order and Cancellation Policy.

Availability, order minimums, deposits, payment deadlines, cancellation requirements, delivery fees, equipment charges, and notice periods may differ from regular online orders.

A catering inquiry does not create a confirmed reservation. A catering order is confirmed only after Mulberry Street accepts the order and any required payment or deposit has been received.

CANCELLATIONS, REFUNDS, AND ORDER PROBLEMS

Cancellations, refunds, credits, replacements, and reports of missing, incorrect, or damaged products are governed by our Refund and Cancellation Policy.

Because we sell fresh, prepared, customized, and perishable food, completed orders generally cannot be returned or refunded because of personal preference or a change of mind.

Nothing in these Terms limits any rights that cannot legally be waived.

PROMOTIONS AND DISCOUNTS

Promotions, discounts, coupons, and special offers may be subject to separate conditions, expiration dates, product exclusions, minimum-purchase requirements, or availability limits.

Unless expressly stated otherwise:

• Offers cannot be combined
• Discounts have no cash value
• Promotions cannot be applied retroactively
• Offers may be modified or discontinued where permitted by law

THIRD-PARTY SERVICES

Our website may link to or integrate with third-party ordering, payment, delivery, catering, mapping, or social-media services.

Third-party services may have their own terms, privacy policies, fees, and operating procedures. Mulberry Street is not responsible for an independent third party’s website, technology, content, availability, or privacy practices.

Orders placed directly through a third-party marketplace may also be subject to that platform’s policies. Questions regarding charges, refunds, or delivery services controlled by that platform may need to be directed to the platform.

INTELLECTUAL PROPERTY

The website and its original content, including text, photographs, graphics, logos, designs, menu presentation, and branding, are owned by or licensed to Mulberry Street and are protected by applicable intellectual-property laws.

You may use the website for personal, noncommercial purposes. You may not copy, reproduce, modify, distribute, publish, sell, or commercially exploit website content without prior written permission.

ACCEPTABLE USE
